Topic description: More and more, companies are turning to wearable devices like Fitbits and Apple Watches to measure employee productivity, safety, and to give insurance companies ways to track health indicators and habits. But despite all of the promise, are there pitfalls employers should be aware of? Does the ability of these devices to measure various health metrics create the risk of an unlawful “medical examination” in violation of the Americans with Disabilities Act? Do GPS-tracking capabilities create potential liability under the National Labor Relations Act? Additionally, who owns the data ultimately collected by these devices? The goal of this program is to discuss this increasingly-popular trend, create awareness of potential legal liabilities, and to permit participants to assess their own organization and whether workplace wearables are the right ‘fit’ for their business. |
